HYROX G'F"T General Waiver and Release

I declare I am physically fit and do not have any ailments. I voluntarily elect to participate in HYROX G'F"T event (“Event”) offered by GymNation LLC (“GymNation”) at GymNation Mushrif Mall on 22nd February 2025.

I recognize that participating in this Event could result in permanent paralysis, death, and other disability, including but not limited to heart failure, loss of consciousness, and stroke. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the GymNation, or others such as volunteers and trainers, and I assume full responsibility for my participation.

I shall observe and obey all posted rules and warnings and further agree to follow any oral instructions or directions given by GymNation’s representative at the Event. If, however, I observe any unusual hazard or uneasiness during my presence or participation, I shall remove myself from participation and bring such to the attention of the nearest GymNation representative immediately.

I expressly agree that GymNation, and their respective affiliates, insurers, employees, personnel, officers, directors, assigns, associates, agents, sponsors, advertising partners, volunteers, interns and sub-contractors (individually and collectively referred to as “Organizer”) shall not be liable for any losses, expenses, or damages arising from any personal injuries (including death) sustained by me as a result of participating in the activities related to the Event, entering any facilities associated with the Event, and/or the use of any  equipment or facilities, regardless of whether such injuries (including death) result, in whole or in part, from the negligence of the Organizer or otherwise. [For the purposes of this release “I”, “me”, “my” and any other similar pronouns shall include any underage minors that accompany me and of whom I am the legal guardian]

I accept and assume full responsibility for any and all injuries (including death), damages, expenses, and losses of any type, which may occur to me, and I hereby fully and forever release and discharge the Organizer, from any and all claims, demands, damages, rights of action, or causes of action, present or future, directly or indirectly, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out of participating in the Event.

I expressly agree to indemnify and hold the Organizer harmless against any and all claims, demands, damages, rights of action, or causes of action, liability, losses (including any loss of, or damage to, any property of, or injury to or death of, any person), and expenses of any kind incurred or suffered by the Organizer that may arise directly or indirectly from my participation in the Event.  

I understand and agree that the Organizer is not responsible for any of my property that is lost, stolen, or damaged while participating in the Event.

I hereby agree and consent to be photographed and video-graphed by Organizer their camera/photo crew and their representatives over the course of participating in the Event and for GymNation to use any content created (which may include my image and likeness, voice or otherwise) across various media channels and platforms worldwide in any manner whatsoever, including sharing such content with third parties to promote such third parties’ products and services. I grant GymNation a perpetual, sub-licensable, irrevocable, non-exclusive license to copy, modify, edit, distribute, publicly perform and publicly display my image and likeness, including any photos and videos taken of me, without any compensation.

I agree to the use my information to communicate with me about the GymNation products and other solutions, events and related resources with an opt-out option at any time using the unsubscribe in messages I receive from GymNation. I also agree that my data maybe shared with partners of the event for co-marketing initiatives.

This waiver and release shall be governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, as applied in the Emirate of Dubai, and any disputes will be subject to the exclusive jurisdiction of Dubai courts.
